Three major news organizations in Australia contended that they could not be held responsible for comments that people posted on their Facebook news pages.

The highest court in Australia ruled that all media companies in Australia are liable for the comments that Facebook users post under their articles.

This simply means that the comments should either be moderated or disabled by the media companies because it is their Facebook pages.

The appeals court insists that in facilitating, encouraging and thereby assisting the posting of comments by others, the media organizations are automatically publishers of those comments.

In the ruling, the court stated that “Having taken action to secure the commercial benefit of the Facebook functionality, the appellants bear the legal consequences.”

However, the news organizations have appealed the ruling.
